L1A Visa To Green Card
You need to be a multi-national executive to be eligible for L1A to Green Card. The L1A Visa is a non-immigrant visa specifically for foreign executives and managers transferred to their companies’ offices in the US. The L1A to Green Card path is one of easiest paths to becoming a permanent resident. It often takes less than 12 months for individuals with an L1A visa to get a Green Card often. Requirements for an L1A Visa To A Green Card
You can only be issued with and L1A Visa if you can prove that you intend to return to your home country. But once you get to the United States, you can petition for a change in status and apply for a Green Card. The Green Card allows you to live in the US permanently. To get the L1A Visa, you must meet the following requirements:
- The company you intend to work for must be multinational with offices in the US and other places outside of the United States
- This multinational company must be controlled by the same person or persons no matter where it is located around the world
- You must be employed in a managerial position with the US company’
- You must have worked in a managerial position with the foreign company for at least one continuous year.
- The US employer must have been in business for one year or more
- You must been employed at the company outside the USA for at least one of the last three years before you started working for the US company
Timeline For L1A To Green Card Process
The length of time it takes to change status from an employment based Visa to a Green Card depends on the priority group you fall under. For instance, people who fall under the EB1 category have their EB1s processed faster than those who fall under EB2 or EB3. L1A Visa falls under the EB1C category, which means that you don’t have to deal with a lot of backlog if you have L1A Visa and are applying for a Green Card.
For example, people that fall under the EB1C category do not have to go through the complex labor certification process that other categories have to go through. Labor Certification is done by the Department of Labor in order to protect equally qualified U.S. workers. For this reason, it is not only an expensive process but also time consuming. People with L1A Visas can get their Green Cards approved in less than 12 months depending on their particular situation.
Application Process For L1A To Green Card Process
First, the US company sponsoring the foreign worker must file a Form i-140 with the USCIS for a Green Card. The USCIS uses this form to establish whether all the requirements have been met. Then the L1A holder will file an i-485 with the USCIS to personally apply for a Green Card. If the i-485 is approved, the L1A holder will get a Green Card.
